They apply to use of this public website and registration for the Gatekey early-access waitlist. By submitting the registration form, you accept these terms. If you do not accept them, do not join the waitlist.
The waitlist is aimed primarily at developers and organisations evaluating a business product. Any future paid gateway service may be offered on a B2B-only basis under separate terms presented before purchase.
2. Website information is not a binding offer
Product descriptions, diagrams, compatibility references, roadmaps, security claims, feature lists, and pricing on this website describe the intended product direction. Unless expressly stated otherwise in a signed order or checkout flow, they are not a legally binding offer, guarantee, service level, or promise that a feature will launch.
Prices displayed on the landing page are indicative B2B prices, exclude VAT, and may change before launch. Joining the waitlist is free and does not create a paid subscription or payment obligation.
3. Waitlist registration
To join, you must:
- provide an email address you are authorised to use;
- give the email consent shown on the form;
- not register another person without their authority; and
- not use automated, deceptive, or abusive signup methods.
A waitlist entry gives no right to a particular ranking, launch date, price, feature, account, free plan, or invitation. We may use reasonable criteria to sequence or limit invitations and may reject or remove fraudulent, duplicate, or abusive entries.
4. Communications and privacy
If you give consent, we may email you about early access, launch availability, and closely related Gatekey product updates. You can withdraw consent at any time by emailing service@xynatec.com. Withdrawal ends future consent-based emails and does not affect prior lawful processing.
Personal data is handled as described in the Privacy Policy. The waitlist currently uses MailerLite and the website is delivered through Cloudflare.
5. The future gateway service
Gatekey is intended to operate as a transparent authentication and policy proxy between a remote MCP client and a customer-controlled MCP server. It is not intended to host the customer’s MCP server or execute MCP tools itself.
Waitlist registration does not authorise use of a gateway and does not govern OAuth processing, MCP traffic, custom domains, audit logs, rate limits, origin tokens, support, service levels, paid plans, or customer data. Those matters require launch terms, a privacy update, and where applicable an Article 28 GDPR DPA.
6. Acceptable use
You must not use the website or waitlist to:
- break applicable law or infringe third-party rights;
- probe, disrupt, overload, or bypass website or API security;
- submit malware, malicious payloads, or fabricated personal data;
- scrape or automate requests in a manner that impairs the service; or
- misrepresent affiliation with Gatekey or another person.
We may block requests or remove entries where reasonably necessary to protect the service or comply with law.
7. Intellectual property and brand references
The Gatekey website, visual design, copy, and original software are protected by applicable intellectual-property laws. Except where law permits, you may not reproduce, distribute, reverse engineer, or commercially exploit them without written permission.
Claude, Cursor, OpenAI/ChatGPT, GitHub, Google, Cloudflare, MailerLite, MCP, and other third-party names and logos belong to their respective owners. Compatibility references identify intended integrations and do not imply sponsorship, endorsement, or partnership.
8. Availability and third-party services
The website and waitlist are provided on a reasonable-efforts basis. Maintenance, security events, network failures, or third-party providers may make them unavailable. We do not guarantee uninterrupted access, delivery of every email, or preservation of a waitlist position.
Links to third-party websites are provided for convenience. Their content, availability, and terms are controlled by those third parties.
9. Liability
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for intentional misconduct, gross negligence, death or personal injury caused by fault, or mandatory liability under applicable product-liability law.
For slight negligence, and to the extent Austrian law permits, we are liable only for a breach of an essential contractual duty and only for damage that was typical and reasonably foreseeable when the waitlist agreement was formed. The free and preliminary nature of the waitlist is relevant when assessing the scope of such duties.
If you are a consumer, all mandatory rights under the Austrian Consumer Protection Act (KSchG), the Consumer Warranty Act (VGG), and other applicable consumer law remain unaffected. No limitation in these terms applies beyond what mandatory law allows.
10. Ending waitlist participation
You may leave the waitlist at any time by contacting service@xynatec.com. We may discontinue the waitlist, close it when invitations are complete, or remove an entry for a material or repeated breach of these terms. Applicable privacy retention rules remain unaffected.
11. Changes to these terms
We may update these terms for future use when the website, waitlist, provider, or law changes. The effective date will be shown at the top. Changes do not retroactively alter accrued rights. If a material change affects an existing waitlist agreement, we will provide reasonable notice and, where legally required, seek renewed acceptance.
12. Governing law and venue
Austrian substantive law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not deprive you of mandatory protections of the law of your habitual residence.
For disputes with entrepreneurs, the court having subject-matter jurisdiction at the provider’s registered office is exclusively competent. Statutory venue rules apply to consumers and wherever an exclusive venue agreement is not legally permitted.
13. Final terms and contact
If a provision is invalid or unenforceable, the remaining provisions continue to apply. The invalid provision is replaced only to the extent and in the manner provided by law; this clause does not reverse the burden of proof or reduce mandatory consumer rights.
